In Florida, a spouse may file for divorce so long as they have been a Florida resident for the preceding six months, with or without your spouse's consent. In order to obtain the divorce, you must agree with your spouse on all issues, or a judge will decide any unresolved issues before granting your divorce. The issues you may need assistance resolving include:

1) Children – You must come to a full Parenting Plan detailing both parents' timesharing rights throughout the year, and child support must be calculated per Florida guidelines.

2) Division of Assets & Debts – You need a Marital Settlement Agreement that details who keeps what and who pays for what.

3) Support – We calculate various child support and alimony scenarios for you depending on your circumstances and goals for your divorce.

Where people go wrong is assuming that, because they can read or because they found some online forms, they can prepare their divorce paperwork. Types of Divorce

There are two types of divorces that impact the cost and duration of your divorce:

Uncontested


Uncontested divorces are much less expensive and quicker than contested divorces. If you and your spouse agree on every single issue, our firm will prepare all of the proper pleadings and attend the hearing necessary to get you divorced. The total cost is a flat fee, including the filing fees paid to the Clerk of Court. This is a non-refundable retainer, so make sure you and your spouse completely agree before you pay for an uncontested divorce.

Contested


If the parties cannot agree on every single issue, the divorce is contested. We offer different levels of contested representation, with flat fees for negotiation with your spouse's attorney or for attendance at a mediation session. If a court hearing is necessary on one or more issues, then hourly fees will likely apply.
